Virtu Cathedral Associates, LLC is on the receiving end of a lawsuit that claims it misclassifies its employees as independent contractors and fails to pay them proper overtime wages. The plaintiff alleges that he worked for the defendant as a maintenance worker and that the defendant maintained control over most aspects of his job. According to the complaint, the plaintiff did not have power to negotiate his rate of pay, was required to adhere to company policies and procedures, had to request permission for time off, and received his work assignments directly from Virtu Cathedral Associates. Because of this, the suit argues that the plaintiff cannot be classified as an independent contractor, which would allow him more control over his work.
The plaintiff claims his misclassification caused him to be unlawfully denied overtime wages and seeks monetary relief for himself and similarly situated employees.
