Ryze Claim Solutions LLC is facing a former employee's claims that she was misclassified as an independent contractor and didn’t receive proper overtime wages as a result.
Ryze Claim Solutions LLC is the defendant in a proposed collective action in which a former employee claims she was misclassified as an independent contractor and didn’t receive proper overtime wages as a result.
According to the complaint, the plaintiff was employed as a claims adjuster between September 2017 and March 2018 and was paid a day rate that didn’t vary depending on the number of hours she worked. The woman says she should have been classified as an employee rather than a contractor because the defendant controlled her pay rate, provided the equipment and facilities needed for her to perform her job, closely supervised her work, and didn’t allow her to work for other employers during her tenure with Ryze.
As a result, the case argues, the plaintiff worked more than 40, and many times up to 60, hours per week without being paid appropriate time-and-a-half overtime wages due to her alleged misclassification.
