A lawsuit recently removed from state to federal court in California alleges Ulta Salon, Cosmetics & Fragrance, Inc. underpays its retail store managers and assistant managers statewide.
The plaintiff in the case says she worked as an hourly paid manager at the defendant's Fairfield location between July 2016 and June 2018. During her nearly two-year tenure with the company, the woman was allegedly denied proper overtime wages for the hours she worked over 40 each week. The alleged wage infractions, according to the lawsuit, stemmed from Ulta’s policy of failing to include in its time-and-a-half overtime calculations the non-discretionary bonuses workers earned by meeting sales quotas.
The lawsuit takes further issue with Ulta's alleged failure to provide a second 30-minute meal break and proper 10-minute rest periods when employees worked a 10-hour shift. The plaintiff claims she and similarly situated workers are owed one hour of pay at their regular wage rate for each workday during which a meal or rest break wasn’t provided.
