A man formerly employed by Tillis Pest Control, Inc. has filed a proposed collective action against the company that claims he was not paid proper wages in violation of the Fair Labor Standards Act (FLSA). The plaintiff, who was employed by the defendant for more than six years through November 2016, claims he and similarly situated individuals were not paid mandatory time-and-a-half hourly overtime wages for all hours worked past 40 in a workweek. At the heart of the suit are claims that the plaintiff and others were incorrectly classified as exempt from overtime pay under the FLSA.
