Filed: February 16, 2017 ◆§ 3:17-cv-00264
A former Bank of America, National Association inbound specialist has filed a proposed collective action against the company that claims it violated the FLSA.
A former Bank of America, National Association inbound specialist has filed a proposed collective action against the company that claims she and roughly 100 similarly situated workers at its Farmington, Connecticut location were deprived of their rightful minimum and overtime wages. The lawsuit, which describes the alleged wage and hour violations as “widespread,” claims Bank of America failed to pay its inbound specialists for all hours worked since proposed class members were required to show up at least 20 to 30 minutes before the scheduled start of their shifts to “open the computer programs used by them to respond to inbound calls.” The plaintiff claims the employees were not paid for this off-the-clock work time in violation of the Fair Labor Standards Act (FLSA).
