Gilmer Lodging, Inc. and an individual are on the receiving end of a proposed collective action filed by a former employee who claims they failed to pay her minimum and overtime wages in accordance with the Fair Labor Standards Act. The plaintiff alleges that she worked as a desk clerk at the defendant’s Executive Inn located in Gilmer, Texas. She says she was paid a fixed weekly rate of $100 and worked between 40 and 48 hours per week. According to the suit, the plaintiff’s pay fell below the required minimum wage and never included overtime compensation for any hours she worked above 40 each week.
