Former Employee Claims True North Energy Did Not Pay for All Hours Worked

A former assistant store manager alleges True North Energy and two subsidiaries owed current and former employees unpaid wages.

True North Energy, LLC, True North Holdings, Inc. and True North Management, LLC are facing a proposed collective action that alleges the entities failed to pay employees for all hours worked. The lawsuit, filed by a former Cleveland, Ohio assistant store manager who was employed by True North from June 2015 through June 2017, alleges the plaintiff worked an average of between 40 and 65 hours per week, with some of those hours marked as “unpaid” by the defendants. The plaintiff claims she, at the direction of the defendants, was told not to clock in when performing work prior to her scheduled shift start time, and to clock out at the end of her shift despite being required to continue working. The lawsuit claims Truth North often marked the hours the plaintiff worked above 40 each week as “unpaid,” and adjusted her clock-in and clock-out times to avoid paying proper wages.
The complaint notes True North is already facing another lawsuit filed in May 2016 by a former assistant manager over similar allegations of off-the-clock work going unpaid. The plaintiff in the case at the bottom of this page chose not to opt into that lawsuit, which has since settled, as it reportedly does not include certain hourly employees.
