A proposed class action filed on behalf of current and former servers employed by Florida's Flying Biscuit Café claims the workers were not paid proper overtime.
A proposed class action filed on behalf of current and former servers employed by Florida’s Flying Biscuit Café claims the workers were not paid proper minimum and overtime wages under the Fair Labor Standards Act (FLSA). According to the complaint, the defendants engaged a policy of forcing servers to pay for their own uniforms and other items without reimbursement. These practices, the suit argues, allegedly cost the defendant’s employees “potentially millions of dollars of compensation and related damages.” Additionally, the case notes the defendant illegally took a tip credit on proposed class members’ wages.
Proposed class members include hourly paid servers, bartenders and managers employed by the defendant within the last three years.
