A proposed class and collective action lawsuit has been filed against 82 Food Corp., PS Food Corp., and two owners claiming violations of the Fair Labor Standards Act.
A proposed class and collective action lawsuit has been filed against 82 Food Corp., PS Food Corp., and two owners claiming violations of the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL). The New York supermarkets, which do business as Key Food, supposedly failed to pay their employees minimum and overtime wages and neglected to provide them with weekly paystubs, according to the lawsuit. The plaintiffs report that they regularly worked up to 54 hours per week and were paid a fixed weekly salary in cash at the end of each week that did not amount to the minimum wage or include time-and-a-half overtime pay, the complaint says.
The proposed class includes retail supermarket employees who were employed by the defendants after March 15, 2014 and were denied minimum wage and/or time-and-a-half overtime pay.
