A proposed collective action citing alleged violations of the federal Fair Labor Standards Act (FLSA) has been filed on behalf of welders employed by Petroplex Pipe.
A proposed collective action citing alleged violations of the federal Fair Labor Standards Act (FLSA) has been filed on behalf of welders and helpers currently or formerly employed by oilfield services group Petroplex Pipe and Construction, Inc. The 16-page lawsuit alleges employees were not paid proper minimum and overtime wages.
The two named plaintiffs behind the lawsuit claim the defendant illegally classified them and similarly situated workers as independent contractors exempt from receiving overtime pay. When oilfield activity was at its peak, the lawsuit says, the plaintiffs and those similarly situated would routinely work between 50 to 100 hours per week without being paid time-and-a-half hourly overtime compensation.
