Lucas County, Ohio, and its county auditor, sheriff's office and juvenile detention center have been hit with a class action seeking unpaid overtime wages.
Lucas County, Ohio, and its county auditor, sheriff’s office and juvenile detention center have been hit with a class action seeking unpaid overtime wages under the Fair Labor Standards Act (FLSA). Filed on behalf of current and former deputies and corrections officers, the lawsuit claims employees were forced to work on “off duty projects” in addition to working regular shifts and overtime. One such project, the complaint says, was performing security work at the Juvenile Assessment Center. The suit argues the defendants illegally classified the officers as independent contractors for tasks done on “off duty projects” – work that often resulted in the plaintiffs working more than 40 hours per week.
The proposed class will cover all current and former employees who worked “off duty projects” for the defendants who were not paid the time-and-one-half overtime rate within the last three years.
