A class action has been filed in Tennessee against Cognosante, LLC alleging the company violated the Fair Labor Standard Act (FLSA).
A class action has been filed in Tennessee against Cognosante, LLC alleging the company violated the Fair Labor Standard Act (FLSA) by failing to pay employees for all hours worked. According to the complaint, the healthcare consulting and business process outsourcing company allegedly did not pay workers for pre- and post-shift “off-the-clock” work. This off-the-clock work, the lawsuit says, included booting up computers to download work instructions and spending time going through mandatory security checks. The plaintiff says the defendant would not recognize employees as “clocked in” until after these and other pre-shift activities took place. Further, the plaintiff says employees would regularly work past the time where the defendant would automatically consider workers “clocked out” at the end of shifts.
