The operating entity of Bronx, New York-based Associated Supermarket and its owner are the defendants in a class action filed over alleged Fair Labor Standards Act (FLSA) violations. The lawsuit claims the defendants failed to pay proper overtime wages at the time-and-a-half hourly rate for all hours worked over 40 in a week. The plaintiff, who stocked shelves and ordered products at the supermarket from 2011 through September 2016, says he was given an inflated “manager” title even though he had no managerial responsibilities. The lawsuit claims the plaintiff worked between 10 and 11 hours per day and was paid a flat rate regardless of how many overtime hours he worked.
