All Shore Paving Corp and its owner are the defendants in a class action claiming the parties violated the Fair Labor Standards Act (FLSA) by failing to pay employees proper overtime wages. Filed in New York, the complaint alleges the plaintiff worked six days per week—a total of roughly 66 hours—without being paid at the time-and-a-half overtime rate. The plaintiff claims he was paid a flat rate per day in cash and received no wage statements.
The proposed class covers anyone currently or formerly employed as a laborer by the All Shore Paving Corp. between November 8, 2013 and the present who was not paid FLSA-appropriate overtime wages.
