A flower business made up of two shops and 14 outposts in Duane Reade stores throughout New York City is on the receiving end of a former employee’s proposed collective action that stems from allegedly unpaid overtime wages. Mrs. Bloom’s Direct, Inc. and Mrs. Bloom’s Mobile LLC, which do business as Mrs. Bloom’s, and two individuals with day-to-day oversight of the business allegedly did not pay employees proper time-and-a-half overtime for hours worked past 40 in a workweek.
According to the suit, the plaintiff’s hours varied greatly throughout her two-year tenure working the defendants. For the span of her employment, the plaintiff says she was paid in a combination of cash and check, yet at no point was she paid proper time-and-a-half overtime. Further, the defendants allegedly withheld all tips the plaintiff made during her last two months of work—and was never notified about it.
The case provides a snapshot into what it allegedly amounts to years of wage and hour abuses:
“From approximately March 12, 2015 until on or about August 24, 2015, [the defendants] paid [the plaintiff] a check for $1,000 for the first 100 hours she worked every two weeks and $9.00 per hour in cash for any hours she worked over 100 in the same two-week period. From approximately November 2016 until March 9, 2017, [the defendants] paid [the plaintiff] a check of $1050 for the first 90 hours she worked every two weeks and $9.00 per hour for any hours she worked over 90 in the same two week period; however, [the defendants] deducted $50.00 from the cash payments [the plaintiff] received for the hours she worked over 90 each two-week period.”
