A proposed class action filed in Florida alleges the below defendants violated Fair Labor Standards Act (FLSA) overtime regulations:
- Antonio Otero, D.D.S., P.A.
- Dr. Otero Dental Center, P.A.
- Dental Cosmetics of Florida, P.A.
- Antonio Otero
- Teresa Otero
The plaintiff, who worked at the above defendants’ firm as a security guard from September 2015 through March 2017, claims he also spent time working for the defendants performing construction and remodeling work at their residence, dental offices, and shopping center. According to the complaint, the plaintiff worked an average of 112 hours per week for the defendants “not regularly getting more than four hours of sleep per night” without being paid anything at all for hours worked over 40 each week.
