Mochika Peru Bistro and its owning and operating entities are the defendants in a proposed class action alleging employees were not paid legally required overtime wages. Citing violations of the Fair Labor Standards Act (FLSA), the lawsuit claims the defendants did not pay its cooks at the time-and-a-half hourly rate for all hours worked over 40 in a week. The plaintiff in the suit says he and similarly situated employees worked an average of 59 hours per week and were never paid their rightful time-and-a-half overtime wages.
