A customer care representative in Florida has filed a proposed collective action against his employer – The Advocator Group, LLC – saying he wasn’t paid overtime wages in accordance with the Fair Labor Standards Act. The suit claims the plaintiff and other similarly situated employees could not be considered exempt from federal wage and hour law, yet were still not paid time-and-a-half wages when working more than 40 hours per week. According to the suit, the proposed class members couldn’t hire or fire other employees, didn’t have control over the business, and had no required special training or skills. The suit is seeking compensation for the employees’ lost wages and benefits, as well as emotional distress and other compensatory damages.
