Five Star Hospitality, Inc. (which does business as Explore Hotel and Hostel) and two individuals are facing claims that they denied employees proper overtime wages.
Five Star Hospitality, Inc. (which does business as Explore Hotel and Hostel) and two individuals have been named as defendants in a proposed collective action filed by a former employee who claims she was denied overtime wages and not compensated for all the hours she worked. According to the lawsuit, the defendants employed a policy that offered paid time off for overtime hours instead of paying employees at the time-and-a-half overtime rate. The plaintiff says she worked a significant amount of overtime hours and never received extra paid vacation time. She further claims that the defendants failed to accurately record her hours and didn’t compensate her for some of the hours she worked, including the entirety of her final week of employment.
According to the complaint, the plaintiff attempted to resolve her individual claims with the defendants, who agreed to settle with her for a certain amount. The suit alleges, however, that the defendants failed to respond to the plaintiff’s counsel to finalize the matter.
