A proposed class action has been filed against Family Counseling Center of Keene, N.Y., Inc., over alleged violations of the Fair Labor Standards Act (FLSA).
A proposed class action has been filed against Family Counseling Center of Keene, N.Y., Inc., over alleged violations of the Fair Labor Standards Act (FLSA). The plaintiff, who was employed by the defendant as a domestic violence residential advocate from 2015 through September 2016, claims she and similarly situated “on call” employees were not paid proper minimum or time-and-a-half overtime wages for hours worked over 40 each week.
According to the complaint, the defendants required the plaintiff and proposed class members to work full-time 40-hour weeks and be “on call” (working one or two 24-hour shifts) on the weekends on a periodic basis. Proposed class members were allegedly only paid for the 40 hours per week they worked, plus a mere $30 stipend for weekend shifts.
