An October 2018 lawsuit filed against Fairway Independent Mortgage Corporation over alleged labor abuses has been removed from state to federal court in California.
The proposed class action claims that the mortgage lender shorted non-exempt employees on overtime wages by failing to include all bonuses, commissions and other payments in the workers’ regular hourly rates of pay. Moreover, the defendant, in violation of state labor law, allegedly failed to provide employees with timely meal periods for shifts lasting over five hours, as well as a second meal for workdays that exceeded 10 hours. The case also charges that workers were not properly granted 10-minute rest breaks for every four hours of work.
The suit goes on to claim the defendant issued wage statements that misstated, among other information, employees’ pay rates and total hours worked. Lastly, the case says the company failed provide former employees with all earned wages upon termination or within 72 hours of resignation.
