Suttles v. Facebook, Inc.
Filed: November 23, 2018 ◆§ 1:18-cv-01004
A Texas man claims Facebook sent him at least 25 unsolicited text messages without first obtaining prior express consent to do so.
The latest proposed class action filed against Facebook details allegations from a Texas consumer who says the embattled social media company sent automated, unsolicited text messages to his cell phone without authorization to do so.
According to the complaint, Facebook sent the plaintiff at least 25 texts in which the company encouraged him to go to Facebook.com or, alternatively, provided verification codes intended for unknown third parties. Though the plaintiff has a Facebook account, the suit says, the man never consented to receive texts from the defendant nor provided the company with his phone number. The plaintiff alleges he continued to receive the messages even after texting “Stop."
