Portable toilet rental company Express Waste of Miami, which operates as Express Portable, is facing a wage and hour class action lawsuit.

Portable toilet rental company Express Waste of Miami, Inc., which does business as Express Portable, and its owner are the defendants in a proposed class action alleging employees were not paid proper minimum and overtime wages. Citing alleged Fair Labor Standards Act (FLSA) missteps, the plaintiff, employed as a full-time cleaning worker from June 7 to June 10, 2017, claims he worked 10-and-a-half-hour days for the (short) duration of his employment. On June 10, the plaintiff reportedly asked the individual defendant when he would be paid, noting he worked 42 hours in four days, to which he was told the company did not pay overtime.
After complaining and requesting his rightful overtime pay, the plaintiff alleges the next day he was told over the phone by a supervisor that he was fired and could pick up his paycheck the following Friday. According to the complaint, the plaintiff’s paycheck was withheld and he received no wages for his brief tenure with the defendant.
