Sohab Inc., which does business as several restaurants operating under the name European Republic, failed to pay employees proper minimum and overtime wages.
Sohab Inc., which does business as several restaurants operating under the name European Republic, failed to pay employees proper minimum and overtime wages pursuant to the Fair Labor Standards Act (FLSA), a proposed class action lawsuit says. The 26-page complaint, which was filed against both the restaurant group and its owner, claims the plaintiff worked between 50 and 80 hours a week without being paid at the time-and-a-half hourly overtime rate for all hours worked over 40. The case also claims that, for shifts lasting longer than 10 hours in a day, the plaintiff was not paid spread-of-hours wages as required by New York labor law.
The lawsuit sheds light on yet another instance of a New York City restaurant allegedly taking a tip credit on employees’ wages to which it is not entitled. The plaintiff says he was never told of the tip credit taken on tips earned through his work as a delivery person. Furthermore, the defendants allegedly paid the plaintiff on a per-delivery basis, compensating him at $1 per delivery no matter how far he had to travel.
