A proposed class action out of Florida claims defendant Estate Landscaping & Lawn Management, LLC failed to pay employees proper overtime wages under the Fair Labor Standards Act (FLSA). The plaintiff, who worked as a landscaper for the defendant from August 2016 through March 2017, claims he was never paid time-and-a-half hourly overtime wages during weeks in which he worked more than 40 hours. According to the case, the plaintiff and similarly situated workers asked to be paid overtime wages for their over-40 work time, but were told “the company had a ‘loophole’ which it could use to avoid payment of overtime.”
