A Florida man has filed a proposed class action claiming defendant Espanola Equities, LLC, which operates The Clay Hotel, and its owners violated the Fair Labor Standards Act (FLSA) by failing to pay proper overtime wages. The plaintiff, who was employed by the defendants as a construction worker from 2014 through January 2017, claims he worked around 65 hours per week without receiving time-and-a-half overtime wages for all hours worked over 40.
The lawsuit also alleges the defendants breached an oral contract with the plaintiff by failing to pay him any wages at all for a total of 33 hours worked during the course of his employment.
