Two servers currently employed by Adelphia Three Corp. and the Phily Diner claim in a proposed class action lawsuit that they are being paid less than mandatory wages.
Two servers currently employed by Adelphia Three Corp. and the Phily Diner claim in a proposed class action lawsuit that they and similarly situated workers are being paid less than the mandatory minimum wage and rely on gratuities for their compensation. The lawsuit claims the defendants illegally take a tip credit to which they are ineligible on proposed class members’ wages, causing the workers’ pay to fall below the minimum benchmark. Instead of being paid at the tipped worker minimum wage of $2.13, the plaintiffs say they and those similarly situated are only paid $1.94 per hour.
