A Kentucky man who worked as a laborer and driver for Wright Tree Service, Inc. has filed suit against the company over allegations that it failed to pay its employees for all the hours they worked. He says he was given an hourly wage and that the defendant paid him properly for his laborer duties but failed to compensate him for driving company vehicles to and from job sites. The driving time, during which the plaintiff allegedly transported co-workers between a parking lot and the properties they worked on, caused the plaintiff’s weekly hours to exceed 40, according to the complaint. As a result, the suit says, he is owed unpaid time-and-a-half overtime wages for all the hours he worked above 40 each week.
