Smooth Sailing, Inc., which does business as Dirty Don’s Oyster Bar, and its owner are staring down a proposed class action filed by two former employees who claim the defendants refused to pay them overtime wages. The lawsuit, which cites both alleged Fair Labor Standards Act (FLSA) and South Carolina Payment of Wages Act (SCPWA) violations, seeks actual and liquidated damages, as well as treble damages pursuant to the SCPWA.
