The Diamond Property Group Inc., two other businesses, and three individuals are the defendants in a proposed collective action filed in New York.
The Diamond Property Group Inc., two other businesses, and three individuals are the defendants in a proposed collective action filed in New York by a former building superintendent who claims the entities failed to pay proper overtime and spread-of-hours wages, as well as maintain accurate work records.
The 22-page complaint officially lists the below as defendants:
- The Diamond Property Group Inc., which does business as Diamond Properties
- Rosenberg-Diamond Development Corp., which does business as Diamond Properties
- 1654 Monroe Realty, LLC, which does business as Diamond Properties
- David T. Diamond
- Jonathan D. Berman
- Robert Rosenberg
The plaintiff, who worked at the defendants’ residential building on Monroe Avenue in the Bronx from 1994 through May 2017, claims he typically worked nearly 60 hours per week between 2011 and 2017 without being paid proper wages under the Fair Labor Standards Act (FLSA) and New York Labor Law. The case notes that on some occasions, the plaintiff was required to work for an additional half hour past his scheduled departure time two days a week and work some Saturday and Sunday hours without pay for this additional work time.
