Fusion Logistics is wrapped up in a class action claiming the the company failed to pay 'day rate' delivery drivers proper overtime wages.
A former delivery driver has filed a proposed class action against “small package, final mile” company Fusion Logistics, Inc. alleging drivers paid on a “day rate” basis are owed unpaid overtime wages. Moreover, the plaintiff alleges there were many weeks when proposed class members—day-rate delivery drivers who worked for Fusion Logistics in Florida within the last three years—weren’t even paid at their agreed upon day rate. Citing alleged Fair Labor Standards Act (FLSA) abuses, the lawsuit claims proposed class members would routinely work between 10 and 15 hours per day, up to six days per week, without being paid time-and-a-half overtime wages.
