A proposed hybrid collective and class action filed in California alleges Red Eyed Jack’s Sports Bar, Inc.—which does business as Cheetahs Gentlemen’s Club or Cheetahs Nightclub—and its owner unlawfully misclassified dancers as independent contractors rather than employees. The case further claims the San Diego gentlemen’s club failed to pay its dancers proper minimum and overtime wages, namely by way of unlawfully retaining proposed class members’ rightful gratuities.
“During the relevant time period, no dancers received any wages—or any form of compensation—from Cheetahs,” the lawsuit alleges. “[The plaintiff] and her fellow dancers generated their own income solely through tips and/or gratuities received from patrons when they performed dance services.”
