Dakota of Rocky Hill, LLC, which operates the Dakota Steakhouse in Rocky Hill, Connecticut, is the defendant in a proposed class action that claims the company failed to pay workers the mandatory minimum wage. The complaint alleges the defendant unlawfully took a tip credit on servers’ wages to which it was not entitled.
“When employers assign non-service work to servers and fail to segregate that time in the wage record those employers must pay all hours worked by servers at the full minimum wage,” the complaint argues.
The two named plaintiffs who filed the lawsuit—one of which is still employed by the defendant—say they were required to perform “significant amounts” of non-service, non-tipped duties, thereby eliminating the eligibility of the defendant to take a tip credit on their wages.
