An adjunct professor/science lab manager has filed a proposed class action against Central Virginia Community College and the Virginia Community College System.
An adjunct professor/science lab manager has filed a proposed class action against Central Virginia Community College and the Virginia Community College System claiming the entities told him he will be ousted from his position as an adjunct instructor on December 20, 2016 because he is reportedly owed overtime wages for his role as lab manager. The complaint notes that the plaintiff began working as a lab manager in 2006 and, after receiving his master’s degree, began working as an adjunct biology instructor—a teaching position exempt from overtime under the Fair Labor Standards Act (FLSA)— in 2012 while still working his full-time lab manager job. According to the complaint, the issue at hand is that even though the plaintiff’s primary role was as a non-overtime-exempt lab manager, he was not paid the time-and-a-half hourly overtime rate for all hours worked over 40 in a workweek.
“As of the date of the filing of this complaint, the representative plaintiff has been told by supervisory employees of the defendants that he will no longer be an adjunct instructor,” the lawsuit reads. “This is because of the defendants’ admission of liability pursuant to the FLSA.”
