Five former employees are behind a proposed class action claiming their former employer, defendant 701 W. 135th Café Inc.
Five former employees are behind a proposed class action claiming their former employer, defendant 701 W. 135th Café Inc. (which does business as Italian restaurant Covo Trattoria), and its owners failed to pay proper minimum, overtime and spread-of-hours wages.
The plaintiffs say they were only compensated by the defendants with tips and were never paid a flat hourly tip-credit wage, much less legally acceptable time-and-a-half overtime pay or spread-of-hours wages for shifts lasting longer than 10 hours in a day. On top of the rampant non-payment of wages, the plaintiffs say they were never told that their tips were being included as an offset for wages, nor that the defendants would allegedly withhold a percentage of workers’ credit card tips.
