Costamar Express Cargo & Shipping, Inc. and its owner are facing a class action claiming the international commercial freight company failed to pay driver proper wages.
Costamar Express Cargo & Shipping, Inc. and its owner are facing a class action out of New York claiming the international commercial freight company failed to pay its delivery drivers overtime wages in accordance with the Fair Labor Standards Act (FLSA). The lawsuit claims proposed class members—who, in addition to driving cargo vans loaded and unloaded overseas package shipments—were paid at a flat rate plus commissions for each customer serviced without receiving overtime owed for the roughly 70 to 80 hours they worked each week.
The plaintiff says he was paid for a nine-hour shift each day but often worked off-the-clock for hours after his shift ended, sometimes until 2:00 AM, due to his heavy workload.
