A proposed class action citing alleged Fair Labor Standards Act (FLSA) violations claims DRF Hospitality Management LLC, which does business as Albany, New York eatery Barto Restaurant, and its owner failed to pay mandatory minimum and overtime wages. The plaintiff, who worked as a waiter and cleaning person from June through October 2016, alleges he worked an average of 78 hours per week without proper pay or breaks throughout his workdays. Further, the lawsuit contends the defendants operated their business with a policy of not paying spread-of-hours wages mandatory under New York Labor Law.
