Action Staffing Solutions, LLC and two individuals are the defendants in a proposed collective action stemming from alleged wage and hour violations of the Fair Labor Standards Act (FLSA). The plaintiff, a laborer who worked for the defendants from August 2015 through April 2016, alleges the staffing company failed to pay him and similarly situated workers unpaid time-and-a-half overtime wages for work done at a Georgia Crown Plaza hotel. The defendants allegedly informed the plaintiff that they simply “did not pay overtime wages,” the case says, and that payroll tax deductions were not made from employees’ wages unless requested.
