Out of New York comes a proposed class action that alleges The Landtek Group, Inc. violated the Fair Labor Standards Act (FLSA) by failing to pay proper prevailing wages to construction workers who performed work as part of a public works contract. The complaint, filed in New York by two former laborers, claims the privately held construction company failed to properly pay the plaintiffs and similarly situated workers at the specific hourly rates, called “schedules,” designated by the type of work they were performing. Further, the suit says proposed class members were also not properly compensated for pre- and post-shift off-the-clock work.
