A class action filed in Oklahoma claims oil and gas production company Crescent Consulting, LLC failed to pay its oilfield workers proper overtime wages under the Fair Labor Standards Act (FLSA). According to the complaint, individuals currently or formerly employed as oilfield workers within the last three years who were classified as independent contractors were not paid the time-and-a-half hourly rate for hours worked over 40 in a week.
Despite being classified as independent contractors, the plaintiff says he and similarly situated proposed class members had almost every aspect of their work day controlled by the defendants.
