Class Action: Fashion Brand Tapestry Owes Unpaid Wages Stemming from Unpaid Security Checks

A former California retail employee alleges Tapestry failed to pay proper wages stemming from time spent by workers undergoing mandatory security checks.
Tapestry, Inc., which boasts Coach New York, Kate Spade New York and Stuart Weitzman in its stable of fashion brands, is the defendant in a proposed class action filed by a former retail worker in California who claims he’s owed unpaid minimum and overtime wages.
Recently removed to district court, the complaint states the plaintiff worked for Tapestry at its Stuart Weitzman retail store in Canoga Park, California from April 2016 through June 2018. The suit traces Tapestry’s alleged wage and hour violations to its security/loss prevention policy, under which all sales employees must have personal items checked prior to leaving a store for breaks and at the end of shifts. As a result, the case continues, employees do not receive duty-free meal and rest breaks, nor commensurate pay, for time they must spend undergoing security checks.
“Sales employees, including [the plaintiff], would clock out in their respective stores, and would wait to have another Tapestry employee to inspect their bags, clothing, and other items,” the suit says. “This was all done off-the-clock and in violation of the Employment Laws and Regulations.”
