Wells Fargo is the defendant in another class action, with the latest case alleging the embattled financial giant failed to pay proper overtime wages to its home mortgage consultants. Filed in Massachusetts, the complaint lays out claims that the employees were paid at an hourly rate plus commissions based on loan volume closed per month without receiving time-and-a-half for hours worked over 40 per week.
The lawsuit says proposed class members routinely worked more than 40 hours per week, yet were not allowed to input any overtime hours into Wells Fargo’s timekeeping system. According to the plaintiff, home mortgage consultants were required to participate in quarterly off-site events and after-hours call sessions, as well as work on weekends to meet sales lead goals, without overtime pay. Worse, Wells Fargo allegedly employed a policy of reprimanding and threatening employees who reported working overtime.
