A Florida woman has filed a proposed class action claiming LaMi Products, LLC failed to pay her and more than 500 other merchandisers proper overtime wages.
A Florida woman has filed a proposed class action claiming LaMi Products, LLC failed to pay her and more than 500 other merchandisers proper overtime wages. The defendant, which the lawsuit says services more than 7,000 grocery stores and more than 20,000 retail outlets, allegedly violated the Fair Labor Standards Act (FLSA) by not paying proposed class members time-and-a-half hourly overtime wages for all hours worked over 40 in a workweek.
The lawsuit further claims the defendant failed to keep accurate employee time records and “allocated an artificial amount of time worked for each [proposed class member’s] assigned stores. The defendants allegedly did not pay the plaintiff for time spent travelling in between stores or for overnight work-related travel.
The case notes the defendant was sued in June 2015 over similar alleged wage and hour violations. That case was settled, the complaint continues, in October 2015.
