California
An October 2018 proposed class action filed against construction material manufacturers Boral Industries, Inc and Boral Roofing, LLC over potential labor violations has been removed from state to federal court.
The individual behind the lawsuit, who worked as a non-exempt factory employee, claims he was deprived of proper wages under California Labor Code due to missed meal and rest breaks. Under California law, the suit says, employees are entitled to two meal breaks and three rest periods for shifts equal to or greater than 10 hours. The plaintiff alleges he was only granted one meal break and two rest periods during his 12-hour shifts and says the defendants failed to provide an additional hour of pay for each missed break.
According to the case, the plaintiff complained about not receiving his second meal break at the start of his employment in April 2018. Despite being told that he was only allowed one meal break, the suit continues, the plaintiff took a second break during a shift in May 2018 and was fired the next day.
All told, the case estimates that the defendants owe the putative class a total of $12,467,921.55 in unpaid wages.
