Class Action Against Musk, America PAC Claims Some Penn. Voters Who Signed Petition Were Stiffed on Promised Pay

A proposed class action lawsuit against Elon Musk, America PAC and Group America, LLC alleges the defendants have failed to pay registered voters in Pennsylvania who were promised cash in exchange for signing and referring others to sign the political group’s petition to support the First and Second Amendments.

The 12-page breach-of-contract class action against Musk says his political action committee, America PAC, initially offered $47, later increased to $100, to any registered voter in the Keystone State who signed the group’s “Petition in Favor of Free Speech and the Right to Bear Arms.” The defendants also offered an initial $47 payment, later increased to $100, for each successful referral of a registered voter in Pennsylvania who signed the petition, the filing relays.
According to the suit, these offers were repeatedly advertised to the general public at campaign events and on social media, and Musk’s offer to Pennsylvania voters ultimately garnered 47.8 million views on X, formerly known as Twitter.
The plaintiff, who worked as a canvasser for America PAC and Group America, LLC, alleges that proposed class members have not been paid in full for their signatures and/or referrals.
“Leading up to the November 2024 election, while canvassing in Pennsylvania, Plaintiff referred many voters to sign the America PAC petition,” the complaint reads. “However, Plaintiff was not paid the full promised amounts for these referrals.”
The class action suit states that although the plaintiff was paid for some referrals he obtained—“albeit well after he performed the work to obtain these referrals,” the suit points out—the man is owed an estimated $20,000 for unpaid petition referrals.
“Plaintiff has repeatedly contacted Defendants, making multiple attempts to receive full payment for his referrals, but to no avail,” the filing claims, alleging the plaintiff has endured “significant emotional and physical distress” as he relied on these payments to pay bills.
The Elon Musk-America PAC class action lawsuit looks to cover all individuals who were registered voters in Pennsylvania when they signed the America PAC petition, or who referred Pennsylvania voters to sign the petition, and have not received the agreed-upon payments from Musk, America PAC and Group America, LLC.
