A class action has been filed in California against the city of Manteca claiming current and former employees were not properly compensated for overtime hours.
A class action has been filed in California against the city of Manteca claiming current and former employees were not properly compensated for overtime hours as required by the Fair Labor Standards Act (FLSA). The suit says the defendant utilized an “illegal compensation computation method” that undercounted workers’ regular rate of pay, resulting in underpayment for overtime hours worked. Specifically, plaintiffs claim the defendant, when calculating workers’ regular rates of pay, did not factor in compensation paid to workers who declined to participate in employer-provided health insurance.
The proposed class covered anyone who has worked for the city of Manteca within the last three years who has not received complete statutory overtime wages.
