Choi's Sports Time, LLC, which does business as Sportstime Bar & Grille in Duluth, Georgia, and its owner are the defendants in a lawsuit over unpaid wages.
Choi’s Sports Time, LLC, which does business as Sportstime Bar & Grille in Duluth, Georgia, and its owner are the defendants in a proposed collective action over allegedly unpaid minimum and overtime wages. The plaintiff, a former server at Sportstime Bar & Grille, claims he and proposed collective members were paid $2.13 an hour pursuant to a tip credit that the defendants were not entitled to collect. Additionally, the defendants allegedly failed to pay proposed collective members proper time-and-a-half overtime wages for all hours worked past 40 in a workweek.
The complaint further alleges:
- The defendants failed to pay any hourly wage to servers or bartenders, instead only compensating the workers through earned tips
- The defendants failed to provide employees with proper notice that a tip credit would be taken on their wages
- Despite receiving numerous complaints about their wage practices, the defendants took no action to fix the issues
