ONG Amnuay Inc. and two individual owners are on the receiving end of a proposed collective action lawsuit that alleges they failed to pay their employees proper wages or provide required wage documents. The plaintiffs regularly worked at the defendants’ Chaamlex Thai restaurant for more than 40 hours per week, but were not paid proper time-and-a-half overtime wages for the hours they worked in excess of 40 weekly, according to the complaint. They claim they were denied minimum and overtime wages and were not given weekly wage statements that accurately detailed their hours and rates of pay. One of the plaintiffs says he was paid only $150 cash for working approximately 278 hours during a four-week period. The complaint cites alleged violations of the Fair Labor Standards Act and the New York Labor Law and seeks to cover a collective of people who worked for the defendants at the Chaamlex restaurant during the past three years.
