A current employee has filed a lawsuit against commercial contractors Campany Roof Maintenance Roofing Division, LLC and its owner that seeks to recover overtime wages.
A current employee has filed a proposed class action against West Palm Beach, Florida-based commercial contractors Campany Roof Maintenance Roofing Division, LLC and its owner that seeks to recover allegedly unpaid overtime wages. The plaintiff, who’s worked for the defendants since 2010, claims he has worked more than 40 hours during every week of his employment, but has been compensated for only those 40 hours or less in each week.
“Consequently, [the plaintiff] had a regular schedule from Monday to Saturday from 6:00 AM to 5:30 PM, and often did not stop working until 6:00 PM,” the case details. “Additionally, there were times when [the plaintiff] was sent to locations that would not have him completing his work day until 7:00 PM that night. Therefore, [the plaintiff] worked approximately 65 to 70 hours in a normal work week.”
The plaintiff’s paystubs each week only reflected 30 to 40 hours of work time each week, the lawsuit argues, meaning he was never paid at the time-and-a-half hourly overtime rate required under the Fair Labor Standards Act (FLSA).
