Current and former bus drivers have filed a class action lawsuit against the Sarasota (Florida) County School Board claiming they were unlawfully denied overtime pay.
Current and former bus drivers have filed a class action lawsuit against the Sarasota (Florida) County School Board claiming they were unlawfully denied overtime pay. The suit claims the hourly bus drivers were not paid for time working before and after completing routes. This work, the lawsuit says, included pre- and post-trip bus inspections, cleaning, fueling, writing directions, making seating charts, filling out conduct reports, attending meetings with supervisors and a long list of other work tasks. The Fair Labor Standards Act (FLSA) requires non-exempt workers to be paid at a time-and-a-half overtime rate for each hour worked over 40 in a week. The case specifically alleges the defendant enforced a policy wherein bus drivers would only be paid for an extra half hour of work despite having to complete a list of at least 37 job responsibilities that normally takes much longer to complete.
